America's POW's -- Our Troops held in Camp Pendleton are shackled and held in solitary
By Aussiegirl
Here's the story in the LA Times about the shameful treatment of our own fighting men who are being held shackled and in solitary confinement on as yet unfiled and unstated charges.
The military and the politicos have evidently decided that they are going sacrifice these men on the altar of appeasement and political correctness. Don't forget that the witnesses here are all the enemy. And to add insult to injury, the military are leaking damaging information to the press ahead of any charges even being filed or any information being presented to the defense lawyers, much less before a fair trial.
This is shameful and disgusting. There is no reason these men should be treated this way. They are not a danger to others. They are not a flight risk. There is no reason for this other than simply wanting to make examples of them to show how "sensitive" our modern military is. This PC war garbage has to stop.
Here is the letter sent to Michael Savage from the defense attorney of this Navy Medical Corpsman:
Dear Dr. Savage:
My Secretary handed me a document this evening which stunned me. It was a document from the investigation which had been scanned and e-mailed to my office by a member of the media. I don’t know who leaked the document- - whether it was an "unnamed Pentagon official," NCIS, or a politician with an agenda- - but I do know that it is an outrage that the only piece of documentary evidence I’ve seen so far in this case came from a member of the media and not from the Marine Corps. As my client sits shackled in solitary confinement in the Marine Corps Brig with charges yet to be filed, the Marine Corps has stooped to leaking portions of the investigation in order to advance their case in the media.
This maneuver calculated solely for the benefit of an agenda constitutes a miscarriage of justice to the prejudice of my client and all involved. The intentional circulation of this document should shock the conscience of all Americans concerned with the fair treatment of our men and women in uniform. I am outraged that government officials would trample on the constitutional rights of a decorated military member in an effort to meet an agenda. This type of malicious action jeopardizes any chance my client and these Marines might have had for a fair trial. An independent congressional inquiry should commence to investigate this impermissible conduct.
In a similar vein, I am troubled by the "unlawful command influence" at the highest levels. When the commander-in-chief and other high level military officials are passing on the guilt of these men and making statements regarding punishment based on pure conjecture, what message is that sending to their military subordinates who will be charged with rendering a fair judgment in this case? Any potential military juror has already seen and heard their superiors at the highest levels intimate their personal verdicts. That kind of influence is patently unjust and, I’m afraid, will operate to taint the judgment of what is supposed to be an impartial fact-finder. My client’s opportunity for justice has been irreparably compromised even before the first charge has been filed.
It is a sad day in military justice when honor on the battlefield takes a back seat to political agendas.
Thanks again for your support. You are a true American.
Jeremiah J. Sullivan, III
Lawyer Decries Sailor's Brig Stay - Los Angeles Times
A Navy corpsman is being subjected to cruel and unusual punishment while being kept in the brig at Camp Pendleton awaiting charges in the death of an Iraqi, the prisoner's attorney said Tuesday.
Attorney Jeremiah J. Sullivan III said his client, whom he described as a 20-year-old corpsman who has served two combat tours in Iraq, is in solitary confinement and is shackled when he is let out of his cell to exercise.
ADVERTISEMENTSullivan told reporters that the treatment afforded his client is harsher than that meted out to accused terrorists being kept in confinement by the U.S. military.
"It's cruel and unusual, and it's unnecessary," Sullivan said.
The corpsman is being held pending charges in the April 26 death in Hamandiya of an Iraqi man. Seven Marines also are being held in the brig and four other Marines have been restricted to base.
Officials have said the eight troops in the brig are suspected of dragging an Iraqi man out of his home, killing him and then planting a shovel and AK-47 near the body to suggest that he had been planting a roadside bomb.
A Marine spokeswoman denied that any of the suspects were being treated cruelly.
Capt. Carrie C. Batson said that after an initial investigation, a decision was made by officials that the eight members of the 3rd Battalion, 5th Regiment, 1st Marine Division, should be given "the maximum level of restraint."
"Consequently," she said, "when service members leave their cell, they are fully restrained with handcuffs attached to a leather belt and leg cuffs while being escorted by a correctional specialist as a safety precaution."
Batson said the eight have access to books, television and music, are medically evaluated several times a day, and may receive visits from a chaplain.
Sullivan, a former Navy attorney who successfully defended two SEALs accused of mistreating a prisoner being brought to the Abu Ghraib prison, predicted that charges of murder, kidnapping and conspiracy would be filed this week.
During interrogations, he said, his client has been threatened with the death penalty.
Sullivan said his client received a Purple Heart for his first tour in Iraq. "He put his life on the line for all of us."
Also, in a heart-rending letter from the Navy Corpsman's wife, she relates the nubmers of heavy casualties that this company received, and how two of the men died in the arms of this very Corpsman who is now held in solitary in shackles. For shame!
